These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and ANOMALY DEVELOPMENT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ ("Company," "we," or "us"). These Terms govern your access to and use of our tower defense mobile game, including online accounts, ranked play, leaderboards, and seasonal features ("the Game").

By downloading or using the Game, you agree to these Terms. If you do not agree, you must not use the Game.

2. Eligibility and Age Requirements

The Game is intended for a mixed audience. By using the Game, you represent that you meet the minimum age of digital consent in your country (typically 13 in the US/EU, and 18 in India). Minors must have permission from a parent or legal guardian to create an account for ranked play.

3. License and Ownership

3.1. License

We grant you a personal, non-exclusive, non-transferable, and revocable license to use the Game for personal entertainment.

3.2. Proprietary Rights

The Game—including source code, tower defense mechanics, graphics, and music—is the exclusive intellectual property of the Company, protected by Article 74 of the Polish Copyright Act.

4. Accounts and Ranked Play

4.1. Account Features

You may play locally without an account. However, accessing ranked leaderboards and seasonal rewards requires an online account.

4.2. Accuracy

You must provide accurate information. We reserve the right to suspend accounts using offensive nicknames or fraudulent data.

4.3. Seasons

We may reset rankings or modify seasonal mechanics at our discretion to maintain game balance.

5. Virtual Items and Digital Cosmetics

5.1. Nature of Items

You may purchase or earn digital goods (avatars, borders, backgrounds). These are "Virtual Items" and represent a limited, revocable license. They have no "real-world" monetary value.

5.2. Non-Transferability

Virtual Items are tied to your specific account identifier and cannot be sold, traded, or transferred to other users.

6. Account Deletion and Forfeiture

6.1. Permanent Action

You may delete your account at any time using the "Remove Account" button in the Game settings.

6.2. WARNING - Loss of Items

WARNING: By requesting account deletion, you explicitly acknowledge and agree to the permanent forfeiture of all associated personal data and all purchased or earned Virtual Items (avatars, borders, backgrounds). These items cannot be recovered, transferred, or refunded once the account is deleted.

7. Payments and Refunds

7.1. Platform Terms

All transactions are processed by the Google Play Store. Their billing terms apply.

7.2. EU/UK Withdrawal

You have a 14-day right of withdrawal for digital purchases. However, by purchasing and immediately accessing a digital cosmetic, you give express consent to begin performance and acknowledge that you lose your right to a refund once the item is delivered to your account.

7.3. Australian Consumer Law (ACL)

For Australian users, nothing in these Terms excludes consumer guarantees provided by the ACL. You are entitled to a refund or replacement for a "major failure" of the digital service.

8. Prohibited Conduct

You agree not to:

• Cheat, hack, or modify game code.
• Interfere with Firebase servers or data integrity.
• Reverse engineer the Game (unless permitted by Polish law for interoperability).
• Use the Game for commercial purposes.

9. Liability and Disclaimers

9.1. "As Is"

The Game is provided without warranties of any kind. We do not guarantee uninterrupted access to ranked servers.

9.2. Limitation

To the maximum extent permitted by law, the Company's liability is limited to the amount paid by you for the Game in the 12 months preceding the claim.

10. Governing Law and Disputes

10.1. Law

These Terms are governed by the laws of the Republic of Poland.

10.2. Jurisdiction

Disputes will be resolved by the competent courts in Poland. EU consumers may also bring claims in their country of residence.
